THE UNIVERSITY OF HOUSTON SYSTEM CLERY ACT COMPLIANCE

Each member institution provides their community members with an Annual Security and Fire Safety Report, published on or before October 1st of each calendar year.   

UHS CLERY COMPLIANCE PROGRAM

The UHS Clery Compliance Program is charged with ensuring each member institution complies with the following Clery Act requirements:

• Accurately reports identified instances of crimes defined under The Clery Act to the University community and the Department of Education;
• Alerts the University community to certain crimes in a manner that is timely and will aid in the prevention of similar crimes; 
• Immediately notifies the University community upon conformation of a significant emergency or dangerous situation occurring on campus that involves an immediate threat to the health or safety of students or employees;
• Makes accessible the University's Daily Crime Log;
• Makes accessible the University's Fire Log;
• Timely publication of the University's Annual Security and Fire Safety Report;
• Identifies and trains Campus Security Authorities on Clery Act offense reporting;
• Complies with all other Clery Act specific policies and procedures. 

CLERY GEOGRAPHY 

Under the Clery Act, crimes reported to have occurred on any of the following four locations must be counted and disclosed by the university in the Annual Security Report (ASR).

• On-Campus; 
  • (i) Any building or property owned or controlled by an institution within the same reasonably contiguous geographic area and used by the institution in direct support of, or in a manner related to, the institution's educational purposes, including residence halls; and
  • (ii) Any building or property that is within or reasonably contiguous to the area identified in paragraph (i) of this definition, that is owned by the institution but controlled by another person, is frequently used by students, and supports institutional purposes (such as a food or other retail vendor).
• On-Campus Student Housing; 
• Public Property, within the campus, or immediately adjacent and accessible from campus;
  • All public property, including thoroughfares, streets, sidewalks, and parking facilities, that is within the campus, or immediately adjacent to and accessible from the campus; and
• Noncampus Buildings and Property owned or controlled by the university. 
  • (i) Any building or property owned or controlled by a student organization that is officially recognized by the institution; or
  • (ii) Any building or property owned or controlled by an institution that is used in direct support of, or in relation to, the institution's educational purposes, is frequently used by students, and is not within the same reasonably contiguous geographic area of the institution.

CAMPUS SECURITY AUTHORITY (CSA)

Campus Security Authority or "CSA" is a Clery Act specific term that encompasses four groups of individuals or organizations associated with an institution of higher education.  CSAs are responsible for reporting allegations of Clery Act crimes that are reported to them in their capacity as a CSA.  

The four categories of CSAs:

1. Campus police department or a campus security department of an institution;
2. Any individual or individuals who have responsibility for campus security but who do not constitute a campus police department or a campus security department (e.g., an individual who is responsible for monitoring the entrance into institutional property);
3. Any individual or organization specified in an institution's statement of campus security policy as an individual or organization to which students and employees should report criminal offenses;
4. An official of an institution who has significant responsibility for student and campus activities, including, but not limited to, student housing, student discipline and campus judicial proceedings.
